Privacy Policy

The privacy of your data — and it is your data, not ours — matters to us. This policy explains what The Breathing Class LLC ("The Breathing Class," "we," "us," "our") collects when you use breathingclass.com and the BreathingIQ assessment ("Services"), how we use it, who we share it with, and the choices you have.

In short

  • We collect your name, email, and the wellness measurements you enter into the BreathingIQ assessment.
  • We treat your assessment inputs (age, sex, height, weight, ribcage measurements, breathing style, symptom self-ratings) as consumer health data and ask for your express opt-in when you submit them.
  • We share data only with the service providers we need to run the business (Kit, Resend, our hosting provider). We do not sell your information.
  • We are not a HIPAA-covered entity. Your assessment is wellness/educational — not medical care or diagnosis.
  • You can withdraw consent, export your data, or delete your account anytime by emailing info@breathingclass.com.

Consumer health data — read this section first

The BreathingIQ assessment collects information that several U.S. state laws — including Washington's My Health My Data Act (MHMDA), the Maryland Online Data Privacy Act, and the "sensitive personal information" provisions of California, Virginia, Colorado, Connecticut, and others — classify as consumer health data. Specifically, the categories of consumer health data we collect are:

  • Demographic measurements you enter: age, sex assigned at birth, height, and weight.
  • Ribcage circumference at full inhale and at full exhale.
  • Your self-identified breathing style (vertical, hybrid, or horizontal).
  • Self-reported symptom severity ratings on a 0–5 scale for breathing difficulty, anxiety, stress, energy, sleep quality, digestion, pain, blood pressure, and endurance.
  • The grade (A–F), range-of-motion percentage, and any related descriptive output we compute from those inputs.

How we obtain consent. You give us your express opt-in consent to collect and process this consumer health data when you actively submit it through the BreathingIQ form. We do not infer consent, bundle it with consent to other things, or attempt to obtain it through dark patterns.

Purpose of collection. We collect this data to compute and deliver your BreathingIQ result and grade, to make your assessment history available in your dashboard so you can track progress, and to send you relevant educational follow-ups (only after you've opted into our email program).

Withdrawing consent. You can withdraw consent at any time by emailing info@breathingclass.com with the subject "Withdraw consent." We will stop processing your consumer health data for any non-essential purpose, delete it from active systems within 30 days, and confirm completion in writing.

We are not a HIPAA-covered entity. The Breathing Class is not a healthcare provider, health plan, or healthcare clearinghouse, and we are not a business associate to any of those. Your assessment data is wellness and educational information — it is not a medical record, and it is not used to diagnose, treat, cure, or prevent any condition.

We never sell your consumer health data. We do not sell, share for cross-context behavioral advertising, or otherwise transfer your consumer health data to a third party for that third party's own purposes.

Other information we collect

Identity and contact information

When you take the BreathingIQ assessment, we ask for your first name and email address so we can send you your results and follow-up educational content. If you choose to set a password, we store an encrypted (bcrypt-hashed) version of it so you can sign back in.

Voluntary correspondence

When you email us with a question or to ask for help, we keep that correspondence, including the email address, so we have a history of past correspondence to reference if you reach out in the future.

Website interactions and logs

When you browse our site, your browser automatically shares certain information such as which operating system and browser version you are using. We track that information, along with the pages you are visiting, page-load timing, and which website referred you to us, for performance, security, and analytics purposes.

Cookies

We use cookies on our site for two purposes:

  • To keep you signed in while you move between pages.
  • To remember your preferences (such as unit choice in the assessment).

We do not run third-party advertising trackers. We use minimal first-party analytics to understand how the site is used so we can improve it.

How we use the information we collect

We use the information we collect to:

  • Deliver your BreathingIQ results and grade.
  • Send you email courses, lessons, and product updates related to breath training, when you've opted in.
  • Authenticate you and keep your account secure.
  • Respond to your support requests.
  • Detect and prevent fraud, abuse, security incidents, and other harmful activity.
  • Improve the assessment and the Services themselves.
  • Comply with applicable laws.

How we share what we collect

We do not sell your personal information. We do not share it for cross-context behavioral advertising. We share information only with the service providers we use to operate the business, only the data each one needs to do its job, and only under written contracts that require them to protect it. Our current providers — these are the only categories of third parties that receive your data, and these are the specific items each one receives:

Hetzner Cloud (Germany) All data we store — encrypted at rest on volumes managed by Hetzner. Application and database hosting.
GitHub Container Registry Application code only — no personal data. Storage of the Docker images we deploy.

We may disclose information in response to a lawful subpoena, court order, or other valid legal request, and where allowed by law we will notify you of the request before disclosure. We may also disclose information when we believe in good faith it is necessary to investigate or prevent fraud, security incidents, or other harmful activity, or to protect the rights, property, or safety of The Breathing Class, our users, or the public.

How long we keep your information

We keep your account and assessment history for as long as your account is active so you can track your progress over time. You can ask us to delete your account at any time (see "Your rights" below). When you delete your account, your assessments and personal information are permanently removed from our active systems within 30 days and from backups within 90 days.

Your rights

Wherever you live, you have the following rights with respect to the information we hold about you:

  • Access — see what information we have about you.
  • Correction — fix or update inaccurate information.
  • Deletion — ask us to delete your account and the data we hold about you.
  • Export — get a copy of your assessment history in a portable format.
  • Opt-out of marketing emails — every marketing email we send has an unsubscribe link in the footer.

To exercise any of these rights, email us at info@breathingclass.com. We will respond within a reasonable time, typically within 30 days.

For California residents (CCPA)

The Breathing Class does not sell or share personal information for cross-context behavioral advertising. California residents have the right to know what personal information we have, to request its deletion, and to not be discriminated against for exercising these rights. For visitors in the European Economic Area and the United Kingdom (GDPR / UK GDPR)

The Breathing Class processes your personal information on the legal basis of your consent (when you sign up and opt in to email) and our legitimate interest in operating, securing, and improving the Services. You have the right to lodge a complaint with your local data protection authority. Our infrastructure is located in the European Union (Germany).

How we secure your information

Connections to our website and APIs are encrypted in transit via TLS. Passwords are stored hashed with bcrypt. Database backups are encrypted at rest. We restrict access to your data to the people who need it to operate the business. No method of transmission or storage is 100% secure, but we take reasonable measures to protect your information.

Children's privacy

The Services are not directed to children under 16. We do not knowingly collect information from anyone under 16. If you are a parent or guardian and believe your child has provided us with personal information, email info@breathingclass.com and we will delete it.

Changes to this policy

We may revise this privacy policy as our Services evolve or as the law changes. When we make a material change, we'll update the "Last updated" date at the top of this page and, if appropriate, notify account holders by email. Continued use of the Services after a change takes effect means you accept the new policy.
