Terms Of Service

Thank you for using The Breathing Class. We built it to help you understand and improve how you breathe. Because we don't know every one of our customers personally, we have these Terms of Service to set expectations.

When we say "Company," "we," "our," or "us," we mean The Breathing Class LLC. When we say "Services," we mean our website at breathingclass.com, the BreathingIQ assessment, our educational programs and certifications, and any related product we create. When we say "you," we mean a person who uses the Services.

By using the Services you agree to these Terms. These Terms include important health and liability disclaimers. If you do not agree to any part of them, please stop using the Services.

1. Not medical advice

The Services are wellness and educational tools, not medical care. The BreathingIQ assessment, our programs, videos, articles, and any feedback from our coaches are intended for general informational and educational purposes only.

They are not medical advice, diagnosis, or treatment. They are not a substitute for a relationship with a qualified physician, mental-health professional, or other licensed healthcare provider. Always consult a qualified provider before starting any breathing practice, exercise program, or change in your wellness routine, especially if you have any cardiovascular, respiratory, psychiatric, or other medical condition, are pregnant, or are recovering from injury or surgery.

Some breathing exercises can cause lightheadedness, dizziness, or fainting. Stop immediately if you feel unwell and consult a healthcare professional. Do not perform breathing exercises while driving, swimming, operating machinery, or in any other situation where loss of consciousness could result in harm.

In an emergency, call your local emergency number. The Breathing Class is not equipped to provide emergency or crisis support.

2. Eligibility

You must be at least 16 years old to use the Services. By using the Services, you represent that you meet this requirement and that any information you provide about yourself is accurate.

3. Your account

  1. You are responsible for the security of your account and password. We recommend choosing a strong, unique password.
  2. You are responsible for any activity that occurs under your account.
  3. You must be a human. Accounts created by bots or automated methods are not permitted.
  4. You may not transfer your account to anyone else without our written permission.

4. Acceptable use

You may not use the Services to:

  • Violate any law or regulation.
  • Infringe anyone's intellectual property, privacy, or other rights.
  • Send spam, malware, or otherwise harm our infrastructure or our other users.
  • Scrape, crawl, or copy content from the Services without our written permission.
  • Resell, sublicense, or commercially exploit the Services or their content.
  • Misrepresent yourself or impersonate someone else.
  • Use the Services to provide medical advice or to operate any clinical practice without independent qualification.

5. Intellectual property

The Breathing Class and its licensors own all right, title, and interest in the Services, including the BreathingIQ assessment methodology, all written and video content, the website design, and our trademarks and logos. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our written permission.

The assessment data you enter is yours. You grant us a limited, worldwide, royalty-free license to host, store, process, and display that data so we can provide the Services to you. We will not use your personal data for any purpose other than those described in our Privacy Policy.

6. Paid programs

If you purchase a program, certification, or other paid offering, the price, payment schedule, and refund terms applicable to that purchase will be presented to you before you complete the transaction. We process payments through industry-standard payment processors; payment card details are handled by those processors and are not stored on our servers.

7. Cancellation and account closure

You may close your account at any time by emailing us at info@breathingclass.com. After cancellation, your assessments and personal information are removed from active systems within 30 days and from backups within 90 days, as described in our Privacy Policy.

We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe threatens the safety, security, or integrity of the Services or our other users.

8. No warranty

The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or that any defect will be corrected. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Your BreathingIQ grade is an estimate based on the measurements you self-report. We do not guarantee its accuracy or that any program will produce specific results.

9. Limitation of liability

To the maximum extent permitted by law, The Breathing Class and its officers, employees, contractors, and licensors will not be liable to you or to any third party for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, loss of data, personal injury, emotional distress, or business interruption — arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or the Services, regardless of the cause of action, will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

10. Indemnification

You agree to defend, indemnify, and hold harmless The Breathing Class from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.

12. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we'll update the "Last updated" date above and, if appropriate, notify account holders by email. Continued use of the Services after the change takes effect means you accept the new Terms.

13. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Breathing Class regarding the Services.
